1. Agreement to Terms

By accessing and using Pictorino ("the Service"), operated by BILDI DIGITAL OÜ (registry code: 16571650, Estonia), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

The Service is available to users who are at least 18 years old. By using this Service, you represent and warrant that you are of legal age to form a binding contract.

2. Service Description

Pictorino is an AI-powered portrait generation service that creates professional headshots and portraits from user-uploaded photos. The Service includes:

• AI model training using your uploaded photos
• Generation of AI-enhanced portraits based on your trained model
• Storage of your trained model for 6 months (extendable)
• Download access to generated images

We use third-party AI services (including fal.ai) to process and generate images. Service quality and availability may vary based on these third-party providers.

3. User Accounts

To use our Service, you must create an account using a valid email address or Google OAuth. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must NOT:

• Upload photos of individuals without their explicit consent
• Create deepfakes or misleading content intended to harm others
• Upload inappropriate, offensive, or illegal content
• Use the Service to violate any person's privacy or publicity rights
• Attempt to reverse engineer, hack, or disrupt the Service
• Resell or commercially redistribute generated images without authorization
• Use automated systems or bots to access the Service

5. Photo Upload Requirements

For optimal results, uploaded photos must:

• Be of yourself or individuals who have given explicit consent
• Show clear facial features with good lighting
• Include a variety of angles and expressions (minimum 10 photos)
• Be in JPEG, PNG, or WebP format
• Not exceed 10MB per file or 100MB total

By uploading photos, you confirm that you have all necessary rights and permissions to use the images for AI training purposes.

6. Intellectual Property Rights

Your Content

You retain all rights to the photos you upload. By using our Service, you grant BILDI DIGITAL OÜ a limited, non-exclusive license to:

• Process your photos through our AI systems
• Create AI-generated portraits based on your uploads
• Store your content for the duration of your subscription

Generated Content

You own the AI-generated portraits created from your photos. You may use them for personal or commercial purposes, subject to these Terms. However, you acknowledge that the AI generation process may produce results similar to other users' outputs.

Our Property

The Pictorino brand, website, software, and underlying technology remain the exclusive property of BILDI DIGITAL OÜ. You may not copy, modify, or reverse engineer any part of our Service.

7. Payment Terms

All payments are processed securely through Stripe. By making a purchase, you agree to:

• Pay all applicable fees as displayed at checkout
• Provide accurate billing information
• Accept our refund policy as outlined separately

Pricing and Credits

• Model training: $29.99 (includes 100 generation credits)
• Additional credits available in packs: 25 credits ($3), 60 credits ($6), 150 credits ($12)
• Credits expire 30 days after purchase
• Prices may change with notice; existing purchases remain unaffected

Model Storage

Your trained model is stored free for 6 months. After this period, you may extend storage for $9.99 per 6 months. Models not renewed will be permanently deleted.

8. Refund Policy

We offer a 7-day satisfaction guarantee. You may request a full refund within 7 days of purchase if you've generated 10 or fewer photos. See our detailed Refund Policy for complete terms.

Upon refund approval, your model and all generated images will be permanently deleted from our servers.

9. Privacy and Data Protection

We take your privacy seriously. Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms. Key points:

• We process data in accordance with GDPR and Estonian data protection laws
• Your photos are stored securely and used only for AI training
• We do not sell or share your personal data with third parties
• You can request data deletion at any time

10. Disclaimers and Limitations of Liability

We do not guarantee:

• Specific results or quality of AI-generated images
• Uninterrupted or error-free service
• Compatibility with all devices or browsers
• That generated content will meet your specific requirements

Limitation of Liability: To the maximum extent permitted by law, BILDI DIGITAL OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BILDI DIGITAL OÜ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any third-party rights
• Any content you upload or generate through the Service

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Activity that harms other users or the Service

Upon termination, your right to use the Service ceases immediately. We may delete your data, including trained models and generated images, following termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia. Any disputes arising from these Terms or your use of the Service shall be resolved through:

1. Good faith negotiations between the parties
2. If negotiations fail, binding arbitration in Tallinn, Estonia
3. Small claims court for disputes under €5,000

You waive any right to a jury trial or to participate in a class action lawsuit.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and BILDI DIGITAL OÜ
• Severability: If any provision is found invalid, the remaining provisions continue in effect
• No Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign your rights; we may assign ours without restriction
